1. Scope
These terms apply to digital products, SaaS solutions, premium websites, agency services, consulting, technical implementation and custom software development by General Informatics, unless otherwise agreed in writing.
2. Scope of services
The specific scope of services is defined by the respective offer, contract, project plan, service description or booked digital service. Changes, extensions and additional services are agreed separately.
3. Digital delivery
Services are primarily delivered digitally, for example via websites, web applications, APIs, cloud systems, software repositories, digital communication channels or provided access credentials.
4. SaaS, memberships and subscriptions
For SaaS products, memberships or subscriptions, the term, price, scope of services, limits, cancellation options and billing intervals are defined by the respective offer or product page.
5. Prices and payment
Prices, payment terms, due dates and billing models are defined by the respective offer or product page. Payments may be processed via supported payment providers.
6. Customer cooperation
The customer provides required information, content, access credentials, approvals and contact persons in good time. Delays caused by missing cooperation may affect timelines and costs.
7. Rights of use
Rights of use to work results are granted within the agreed scope. Third-party components, licenses, templates, frameworks or open-source components may be subject to their own license terms.
8. Acceptance
If acceptance has been agreed or is required, the service is deemed accepted if the customer confirms it, uses it in production or does not report material defects within a reasonable period.
9. Availability and third parties
For digital services, maintenance, updates, technical issues or outages of third-party providers may affect availability. External services, hosting, payment providers, APIs or platforms are subject to their respective terms.
10. Warranty and support
Defects are remedied within the scope of applicable law and the agreed services. Maintenance, ongoing support and further development are only owed if expressly agreed or included in the booked plan.
11. Liability
Liability applies within the scope of statutory provisions. Liability for indirect damages, lost profit, data loss, third-party outages or improper use exists only where legally mandatory.
12. Termination
Notice periods and contract terms are based on the respective offer, contract or plan. The right to extraordinary termination for good cause remains unaffected.
13. Confidentiality
Both parties treat confidential information, technical details, access credentials and business secrets confidentially.
14. Final provisions
If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
